Legal Study Group meeting at Delhi on 15-16 October 2019
We are giving the report of the meeting held at Delhi on 15-16 October 2019. Background for the meeting: Our SLPs were listed for arguments on 24th July2018 and were on board for their turn; but on impassioned demand on 31-7-2018 of implementation of DHC order (27/4/2017) SC passed the order stating, “it is stated by learned counsel appearing on behalf of the Life Insurance Corporation that the amount payable to the petitioners under the judgment of the High Court will be paid within a period of eight weeks from today. We expect the Life Insurance Corporation to abide by the statement made by learned counsel and to file an affidavit of compliance soon thereafter”. Thereafter, the question of correct implementation of DHC Order crept in which shadowed the main issue of pension updation. In Feb 2019, a joint meeting of the petitioners was held at Chennai and it was agreed upon that petitioners would focus on the main issues instead of falling in trap of erroneous implementation of DHC order. In the meantime, Justice Lokur retired and no substitute of Justice Lokur was appointed to reconstitute the bench. A lot of procedural changes were in talks in the SC, with regard to priority of listing of the cases and ‘mention’. There were news that some of the petitioners tried to get the cases listed at an early date; but of no consequences. We also observe some positive developments like one more option for pension to those LIC employees/retired employees who had not opted for pension earlier. For RBI pensioners, a sort of modified parity among pensioners with certain restrictions allowed by UOI. Encouraged from such developments, AIRIEF along with other associations met the Chairman (on 24-7-2019) and MoS (Finance) (on 22-8-2019). Purpose of these exercises was to create a positive atmosphere and good relationship with a view to get our grievances resolved through other available avenues.

Not seeing any progress in court cases, many of our members expressed their displeasure and wanted to take up the cases for early hearing. We are very much concerned and distressed by the fact that everyday 3 to 4 pensioners are bidding goodbye to this world. On the other hand some of the members opined to wait and watch the developments in banking industry as their wage revision appears to be closer and hopes of pension revision are also there. On SC website, status of our cases shown from time to time created more confusion. The last order of SC, delivered on 26/11/2018 directed to list the cases for Final Hearing/Disposal at admission stage on a non-miscellaneous date in the week Commencing from 11-02-2019. One thing is clear that whenever the cases are listed and arguments starts, the case will be decided finally. So, we have to ensure that whenever arguments start, our Sr Advocate/s are fully prepared to counter the erroneous part of DHC Order and justify pension updation with wage revision to resolve the grave discrimination being faced by earlier generation of pensioners. In view of such uncertainties and anxieties, it was decided to have the meeting of LSG at New Delhi where we can have the correct status of our cases and if need be we would interact with the advocates. AIRIEF also consulted and invited other associations on this move but somehow, they preferred to watch and wait for the time being. On 15th and 16th October 2019: As decided, members of legal study group met at New Delhi on 15th Oct. 2019 to appreciate the present position of our pension related issues and decide further course of action. After considering and discussing the entire scenario, as stated in aforesaid paragraphs, following points were finalized by LSG: 1. To know correct status of our cases from the original source i.e. office of the Registrar, 2. To assess whether it would be useful to initiate action for early hearing, under the prevailing circumstances in SC, 3. To know the options to get early hearings and to know the procedure for applying for the same, & 4. To ensure that our Sr Advocate/s would be fully prepared for final arguments and winning the case. Our General Secretary requested Shri R K Singh for the meeting and let us know the time and place of meeting. Shri R K Singh suggested to have the meeting at 8.30 to 9.30 am on 16/10/2019 at the place of our stay. On 16th Oct 2019, Shri R K Singh arrived at 8.30 am. We started the meeting and raised aforesaid points before him. After brief clarification by Shri Singh on the aforesaid points, it was decided that we would be meeting again at 2.30 pm in his chamber in the SC. By that time status and correct position of our cases would be obtained from the Registry by his juniors.

We assembled at Shri R K Singh’s office at 2.30 PM. The correct status of the SLPs was obtained by Shri R K Singh. He shared the details with us. This made the position clear. We discussed about the status of some SLPs where certain papers/applications were submitted later. On 17th Oct 2019, Shri R K Singh joined us at 9.00 am for discussion with the Sr/Advocate. Shri Singh is aware of our detailed preparation, anxiousness to ascertain that the Sr Advocate understands and appreciates our issues and prepare himself for the best presentation to ensure sure success. Ours is not a simple case. It is complicated but it has got its own merits. We informed that even some petitioners are sceptic on its success. So, most of the pensioners, irrespective of their union affiliation look towards AIRIEF for achieving their legitimate right of pension updation, similar to other employees of Central Government/State Government/Commissions, etc., as service rules and pension rules of LIC employees are similar to their service rule and pension rules framed by the Central Government. Our feelings are very well made known to the Sr Advocate. All the LSG members opined that keeping in view the overall scenario, we should not dilute our efforts in judiciary.
However, next step of making a mention for early listing and arguments will be taken with due precaution but shortly. Time of making a mention shall be decided by our Sr Advocate keeping in view the probable Bench, suitable time for final arguments, etc. AIRIEF leadership and LSG will be in constant contact of Sr/Advocates and ensure their presence at Delhi whenever called. It is also hoped that the Sr Counsels of the other petitioners also will be present when the MENTION would be made.
