Prayer for stay in Appeal petitions Dear Shri Sahni,  I came across in one of your posts today wherein one of the champions of LIC pensioners' causes has has conveyed his ''Shock" over the seeking of  a stay before the SC of Delhi HC judgement by the Fedn of Retd LIC Class 1 officers'Assns                I hasten to state that there was nothing Wrong in the factual statement made by the GS of the Fedn and I would like to offer the following clarification as a practising Advocate of over 26 years' standing in a HC so that the pensioners in general and members of the Retd class 1 federation in particular do not get any misleading message.               Whenever an appeal is filed in a court having appellate jurisdiction it is not only customary but necessary that as a basic relief a stay of the order appealed against is sought. It does not mean that the seeker of the stay on the impugned Judgment has voluntarily given up his right to plea

Ecircular No.DK/11                                                      27-01- 2018    Friends, I thought some communication was due from our side. Here it goes: 1. As already reported, the next Hearing in the S C had been listed for 15th of May 2018 ,  in the computer generated list of dates. We had also mentioned that this may not be the final word on this matter as the computer generated lists can undergo changes, and that it can be slotted   for an earlier date. Now it is understood that the fresh Computer list indicates 5th of March as the next Date! I must leave this matter to be examined by our Chairman Legal committee who knows better on matters relating to the Courts. 2. In our New-Year eve Ecircular  (DK/5 dt. 31-12-2017) we had given indications of possibilities of certain Groups who had left us, to merge back with us,  & that  it might happen in the year 2018. We are still on with our preliminary spade-work on this and we do feel quite positive about outcomes

Please refer to our earlier circular DK/9 dt. 13-01-2018                     Supreme Court Website indicates the date of next hearing of our cases as 14th May 2018 which is  computer-generated .  The adjournment is much more than 4 months although the time for the already delayed LIC's counter and our reply thereto involves only 6 weeks. That will be the date unless a case is made for by any petitioner for an earlier hearing. We are yet to receive the Counter from LIC.            Sri Jain, our Legal Co. member at Delhi, says he talked to Sri Jaipal, our Advocate's clerk, who explained that the Date  14-05-2018  is computer generated . He was of the view that our case would be listed in the last week of Feb or so.           W

As expected LIC's counsel sought an adjournment. Our counsel counsel pleaded for interim relief. The court granted four week's time for LIC to file counter and two weeks thereafter for us and other petitioners to file rejoinders, if any.
