Sad News of Demiseof Shri S.N.Sundaresan Retd ED... CONDOLENCES FROM GNS

The sad news of the demise of Shri SN Sundaresan (87)on 21/8 has been conveyed to us rather late.Even before his retirement in the cadre of ED he had made coimbatore his home town.He was a member of our coimbatore Assn.and respected by all members.           I recall the days (early eighties) I spent in the Kozhikode DO as ADM when Shri Sundaresan was the Sr.DM.Though we could  not see eye to eye on many office related matters I always had an admiration for his argumentative capacity and the force with which he would articulate his points.We of course had a common matter of interest viz classical Carnatic music of which he was a connoisseur.Many of the top musicians were his personal friends. I knew he was ailing for sometime but he seems to have suddenly met with his end. Our heartfelt condolences to his family. May his soul rest in peace!!-GN Sridharan

The reported meting of group of our friends with the MOS (FS) on 22nd inst is indeed a good move. I am firmly of the view that It is this kind of exercises that may ultimately deliver the goods for us.                   For LIC pensioners we have five representative organisations(Four at national level and one splinter group)There is also  an individual in the fray who claims to be independent.All of them are acting in such a manner that an average pensioner is led to believe that the remedy for all our ills particularly the elusive up gradation would come about only through the judiciary. As a result many have been assuming  the role of 'legal experts' oblivious of the reality, thanks to the blogs for providing a platform for showcasing their expertise .None seems to realise that the up gradation issue will not be decided in isolation for the LIC pensioners alone .It is only in this context I feel that the meeting on 22nd is a welcome move.                  It is my pe

FEDERATION OF RETIRED LIC CLASS I OFFICERS' ASSOCIATIONS Friends,                       Meeting with MOS Finance today at 11 am Happy to inform you that the Pre-arranged Meeting with the Honourable Minister of State for Finance Sri Anurag Singh Thakur, happened as scheduled at 11 am in the Minister's Office at North Block, in New Delhi. I am Reporting to you, following a fairly long chat over phone, with Sri N P Bali, our President, regarding the Meeting. The People who had gone over in the Delegation, were Sri A L  Dhawan, Jalandhar, Sri S N Chhabra, Panchkula,,  Sri T C Chopra, Chandigarh , Sri N P Bali , our President, and Sri M P  Agnihothri, Hyderabad, of AIRIEF. THE MEANING Per incuriam , literally translated as "through lack of care", refers to a judgment of a  court  which has been decided without reference to a statutory provision or earlier judgment which would have been relevant. S IGNIFICANCE The significance of a judgment having been decided  per incuriam  is that it does not then have to be followed as  precedent  by a lower court. Ordinarily, in the  common law , the  rationes  of a judgment must be followed thereafter by lower courts while hearing similar cases. A lower court is free, however, to depart from an earlier judgment of a superior court where that earlier judgment was decided  per incuriam .
