Reg: Some matters of interest for us, Pensioners ..

I have written today to the MD LIC, regarding this year's Existence Certificate from Pensioners, that normally comes up in August every year. I have suggested that the time limit for sending in such Certificates, should be fixed for  November or December, in view of the disturbed conditions existing now, all over the country. The Letter is also reproduced here in this Circular, for the general information of all members.

Incidentally a judgment delivered by the Kolkata HC on 17-06-2020 has come to our notice. This is a judgment which talks about Resignation by employees of Banks prior to Retirement. It seems to equate such Resignation with Voluntary Retirement. As of now eligibility for Pension arises in the case of Voluntary Retirees, but not necessarily in the case of Resignations. This point became relevant in LIC too, when recently, a second option for Pension was allowed, where those who had put in minimum qualifying service for Pension, had later resigned from service, and were not permitted the option for Pension. This judgment of Kolkata HC, which is of 8 pages length, is also reproduced for the benefit of members.

Dear Sri Guptaji,

 

Existence certificate of pensioners due in Aug 2020

Pranams to you, after quite some period of break -- and a tumultuous  one at that, with the COVID 19 playing havoc with our lives and times.. Hope all there at CO and your families are safe and good.

I thought I should write to you in advance reg. the Life/Existence Certificate that falls due in august this year. In view of terrible dislocations all around, the suggestion is that, this time-line of August may be shifted to either Nov or Dec. 2020. Such a change has already been made here in the state Govt of Tamil Nadu -- pushing the limit by 3 months to Nov.

I feel, any other kind of readjustment or concessional approach, keeping the deadline to August will not serve the purpose, as such other methods may involve our moving out of home. I would request you to seriously consider the matter before sending out routine communications regarding Existence Certificate after the first week of July, 2020.
