TODAY AT DELHI HIGH COURT.

Today’s proceedings in DHC Arguments in our cases commenced today in the afternoon, at about  2.45 PM . We would like to convey that it was indeed consoling that this will be indeed the last lap of hearing. The Court had earlier expressed that certain matters of actuarial calculations be explained. LIC had arranged to bring ED (Actuarial) to be present for today’s hearing. She answered a few queries from the Bench. Shri Nidesh Gupta Senior Counsel for other petitioners argued for close to 1 1?2 hours, and stressed that DS Nakara Case well applies our issues as well.  He cited several case laws to strengthen his argument. As it was closing time, he could continue  tomorrow . His focus among others was that pensioners are in a homogenous class and cited sufficient case laws in support of the same. The matter will therefore be resumed at 2.15  tomorrow . We expect our Senior Counsel to put forth his points. We shall communicate again  tomorrow .  GN Sridharan Gen S

Dear Shri Sury, You must be reading the blogs of  PG Chronicle and Sahni My fear is ... will submit a big thesis to the Court on Valuation Process of LIC,  the Court will ask LIC to reply within a month or so, and another month for petitioners to file a counter, and this will go on for months to come and this is what the LIC wants- a red herring to divert Court attention from the main terms of reference by SC. Mediclaim Premium.

Our letter dated  9/2/2017  to ED (Per) on the above subject is reproduced below for your information . "Dear sir,  Re Deduction of premium for policy yr.2017-18 out of pension. It was a measure of great relief for the pensioners when it was decided last year that the share of the premium to be borne by pensioners will be deducted in 12 monthly instalments.     By the time the decision was taken some pensioners at different centers had already paid their premiums in lump or some instalments had been recovered for the cover period of 2016-17.It has been brought to our notice that those who had paid the premiums by a lump deduction for the last year will not be eligible to avail the facility/concession of monthly deduction for the ensuing master policy year.you will kindly appreciate that such a stand is not logical and will be against the spirit of the relief measure agreed to already.        We therefore appeal that suitable instructions clarifying the position to

LIC ADDITIONAL AFFIDAVIT.

LIC Addl Affidavit: LIC has today filed its addl affidavit. There is nothing new in it and is just 'Old wine in new bottle'. G N Sridharan writes: 1: Prospects for 14/2 hearing DHC From the record of proceedings in respect of the last hearing on 25/1/2017, it is noted that the matter will be heard on 'day to day basis' from 14/2. We therefore hope that that the case will be heard on at least two consecutive days and orders reserved at last so that pensioners will be relieved of further tension. Meantime we are advised by our counsel that LIC is expected to file their court mandated addl. affidavit during next week. So far as their earlier affidavit (on which the court had reportedly found fault) is concerned we may inform that we have already filed a suitable reply.  If therefore LIC files an addl. affidavit we shall also file an addl reply. We cannot also rule out the possibility of some of the petitioners seeking time to file their replies. We have to only pray that the hearing schedule does not get upset. 2 .
