An interactive session between representatives of the Federation of Retd. LIC class1 I Officers' Assns and All-India Retd. Insurance Employees' Federation was held at Bangalore on Tuesday the 15th Aug 2017. Representatives of AIIPA had also been invited but they could not attend.
AIRIEF was represented by M/S G Krishnaswamy (Gen. Secy), David John (Jt. Secy) & V Jayaprakash (Treasurer) and Fedn.of Retd LIC Class I Officers' Assns by m/s GN Sridharan (Gen Secy), R Rajagopalan & M Arunachalam (both Legal committee members). M/s TK Ravindran, VS Raghunath ,G Krishna Prasad ,& TJ Bhat, the Office- bearers of the Bangalore unit of the Retired Class I Officers' Fedn.
Shri R Rajagopalan who had kindly hosted the meet while initiating the discussions observed that there should be consensus on (1) engaging a senior counsel taking into account the attendant financial commitments and (2) deciding on securing Interim Relief through the arguments of counsels / senior counsels to be engaged by us.
Shri GN Sridharan,participating in the discussions expressed the view that since six petitioners are filing SLPs against the Delhi HC judgement there should be no difficulty in securing admission. Other participants, particularly Shri R Rajagopalan opined that since we have to get an interim Relief there is need for engaging a senior counsel without delay.
Shri G krishnaswamy reported that some three sr. counsel's names were being considered by his federation and that a final call will be taken by the time the SLPs of both the organisations are numbered. Shri GNS informed that the services of the sr. counsel who had appeared earlier in SC for his federation will not be available. Shri Rajagopalan suggested that the names proposed by him & GNS can be expeditiously followed up. Gen. Secretaries of both the federations informed that their respective SLPs will be resubmitted to the registry during the next couple of days and the progress of engaging senior counsels will be constantly communicated to each other.
After hearing the views of all others who participated in the deliberations,the following emerged as the 'consensus':-
1)Considering that the AIIPA has already engaged a sr. counsel and have secured an adjournment of 3 months and that since both the participating federations are on the lookout for sr. Counsels, then idea of a single / common sr. counsel was not feasible. However, at the appropriate time we can keep liaison with sr. counsels of both.
2) After the SLPs are numbered both organisations will exchange texts of their respective SLPs particularly in regard to the 'grounds' of appeal.
3) The issue of sr counsels' f ees should necessarily be kept in abeyance till at least the Sr counsels are identified.
4) Both shall press for implementation of the new formula of DR neutralisation as a measure of Interim Relief ( though it does not meet our demand for 100% neutralisation) pending final disposal of the SLPs.
5) There shall be another round of meeting in early Oct if not earlier.
