Flash News From the Desk of Federation

17th July 2016 We are aware that our members are anxious to know the steps we are taking to steer our case at the hearing on 4th proximo.  In this connection we may inform that in the context of the non availability of the Senior  counsel (shri Sriram Panchu) who had effectively handled the matter for us in the supreme court, we are now in the process of making alternative arrangements.  We hope to finalise the matter very shortly.  Meantime some of our well meaning friends have been suggesting that since three of the members of our Federations legal committee themselves being practising lawyers we should consider making our own arguments . We are considering this option also. In any case we would like to assure our members that our strategy will be finalised very soon. G N Sridharan  Gen. Secy Federation of retd. When nothing is happening, we munch the past.

When Nothing is Happening  Or  whatever is happening is too boring  what else to do ? Just as a cow munches its swallowed straw, we do recall our past and dwell on them for an hour or two to forget the present.  The past has all the emotive quotients .   From sorrow to ecstasy.  From grief to golden moments . One or two among them stick in our brain cells, never to get erased.  Again, in between, somewhere, a few things do happen in everyone's life which make us smile.   You may wonder why ! I am narrating all these.... This is another bunch of pop corn . Till such time, of course , GNS comes with his news. I know u visit here only for that. Long long ago, full thirty nine years back , at a shore village of Tamil Nadu, I happened to be the front level junior officer, with relatively a bigger table before me than others, who were mostly from erstwhile companies, elderly people,  always looking with an eye of caution on whatever happens around. What happened today at Delhi High Court? G N Sridharan writes: Today's proceedings in Delhi HC Despite attempt by LIC counsel, as expected, to get two weeks adjournment, the cases came up today  ​,  and there were serious discussions on the issues involved.   All the lawyers were present.  The Court heard all the cases during almost one hour in the forenoon.   On an enquiry  by the Bench, the counsel for LIC admitted that they had not filed their counter, and at this, the Judge expressed anguish.  Curiously, our Federation's amended petition was also not in the case bundle but our counsel pointed out the same was fled as early as he first week of June 2016 (our counsel  is following up with the Registry to get the matter set right). There was mention of the fact  by participating advocates that old pensioners seven steps above get pension less than one third of the pension paid to lowest cadre.   The Judge made an enquiry on how the funded sc

IT HAPPEND AT DELHI HC

TODAY HAPPENINGS IN SHORT. NEWS FROM G N S  AT THE DELHI HIGH COURT TODAY JUDGE HEARD THE CASE FOR 45 MINUTES LIC IS TO FILE AFFIDAVIT ON CALCULATION OF THE PAYMENT MADE.  CASE ADJOURNED  FURTHER HEARING ON  4.8.2016 PL AWAIT MORE NEWS.

G N SRIDHARAN  INFORMS: I just reached Delhi, and immediately contacted our Counsel. He informs me that LIC is surely seeking adjournment by two weeks.  We will talk to our Counsel on the further course of action. Await further info  tomorrow . Sri M.Arunachalam , (Vice President, Retd.LIC Class I Officers Association, Chennai ) from Delhi, informs  me ( (the editor of this blog)  I was with advocate on an imp discussion, and i could not take your call.  Afterwards I tried but could not reach you. I anyway resent the earlier mail of the day and  the case is set to be adjourned by two weeks

Dated 10th July 2016 A communication  From G.N.Sridharan  I am now at Lucknow on invitation of of our Assn here to attend  the  AGM being held held today.  I will be at Delhi  tomorrow   where i will be  joined by other members of our legal committee viz M/s VK Jain, R. Rajagopalan, Basudeb Das & M Arunachalam, on the eve of  the hearing  of our case in the Delhi HC on 12/7.  According to the advance list the  cases remanded by the Supreme Court including ours is listed as item 9  before the bench of Justice Sanjeev Khanna & Justice Ms. Sunita Gupta. The new WP filed by others is separately listed under fresh matters. We shall be sending prompt information on what happens on 12th inst.  and we appeal to all members  not to get unduly excited. LIC Class I Officers' Assns. 6th July 2016 A Personal Communication It is a known fact that Pensioners' case  survived, without being a total flop in the SC, only because of our Federation's point of the constitutional invalidity of the Pension Rules Appendix IV - Section 3 A, in our original Petition to Delhi HC.  As already informed to you, we now had the opportunity to expand our plea and prayers in Delhi HC, for the benefit of all pensioners, irrespective of date of retirement. At this juncture, I am sharing with all the activists of our Federation, like you, certain  continued disturbances faced by me in discharging my functions as your General Secretary. I have tried my best to shut myself out of any contest of views by not responding to innuendos , deliberately aimed against me from certain quarters The context is, certain actions being taken by Mr. M Srinivasa Murt
