It is the 12th of March today, and many of you could be left wondering as to what happened to the Hearing that was supposed to have been scheduled for the day. Actually , though the Computer generated list of cases did carry a mention of our case for the 12th, later on, the same was not confirmed on the SC List on Friday the 9th of March. The two who were booked on Flight to Delhi for the 10th had to cancel it last minute, a second time after the first postponement on 5th, causing heavy loss on the Ticket cost.
It is now being speculated that such uncertainty on the Date for Hearing has happened mainly due to all Petitioners involved, not having Filed their respective Rejoinders. The SC Order had stated clearly that after the Rejoinders are Filed by the Petitioners, a date would be decided for the Hearing on the case. It now looks that the cause for such postponements could be linked to the non-filing of Rejoinder by one or more Petitioners. As I had indicated in my last general communication, our Rejoinder was finalized here on the 25th of February, the same was sent over to our Advocate on Record Sri Rajiv Garg same day by e-mail, who took another few days to give it final shape, after due consultations with sri V K Jain our Legal co member in Delhi, and Filed it around the 2nd of March.
We had indications from AIRIEF from their general communication on the Net, that their Legal Co met at Delhi on the 24th of Feb and had detailed discussions in the presence of their Senior Counsel. Though they were ahead of us at this stage, there seems to have been some delay in actually filing their Rejoinder. We are trying to find out from them as to what the real position is. So, we now reckon that even 19th March may be doubtful, in case all Petitioners have not filed their respective Rejoinders. In any case we are duty bound to keep members informed about the Date of Hearing once it gets confirmed. Meanwhile let us hope that we will get a date in March itself so that there is some movement clocked in our matters before the Supreme Court .
