Pensioners’ case in HC Delhi today



At the hearing of the case today, the ASG representing UOI pleaded for further time to file the Government’s affidavit.

 The Bench expressed surprise that their counter could not be got ready though more than three weeks have passed since last hearing. 


The Bench pointed out that that the deadline fixed by the S.C. is ending.

 LIC wanted extension but our counsel pointed out that they should have applied to S.C. for extension instead of stating so before the Court.

 The Bench stipulated that LIC should seek extension from the S.C. immediately, and report back. 

The Bench directed that on being mentioned on 31st Aug in regard to having moved the matter at the S.C., a definite date for argument will be fixed on that day.

The Counsel appearing for a petitioner raised the issue that the IR of 40% has not been made properly. 

The Judge remarked that other petitioners also have submitted varying replies giving different interpretations, but the HC will not go into the issue as the terms of reference from S.C. do not include such issue.

We have instructed our Counsel to inform on 31st instant, the date of final argument.

NO CERTIFICATE ..WE NEED



Re: Case before Delhi High Court

Though we were aware of the high expectations of pensioners on the outcome of the impending hearing on the 29 th we could not send out any communication for the past couple of weeks for valid reasons. 

We were busy concentrating on preparing our written responses on the stand of LIC in the Delhi HC on our amended writ.

 We may inform that we could finalise in time the following materials.-
1) Rejoinder to LIC's Reply to our amended WP 184/2007
2) Reply affidavit to the 'compliance' affidavit of LIC in regard to payment of Interim Relief as per SC order filed by them in WP 3984/2016.

The finalisation of the above called for intense consultations amongst our Legal committee members and everyone contributed to make it a good teamwork M/s R Rajagopalan and Basudeb Das provided valuable inputs.

 Shri M Arunachalam bore the brunt of giving a final shape to our efforts maintaining contact with me continuously.  Shri VK Jain maintained excellent liaison with our counsel with the able assistance of our petitioner shri.Amritlal. I sincerely thank every one of them.

While we were deeply involved in our work as above one "leader' chose to comment in one of his communications that our Federation's ' reservations' in attacking LIC were due to our 'inability' and 'unwillingness'. 

We need no certificate from others who really believe in and bring about in disunity.  We however expect that it may not be easy for LIC to counter the points made out by us in the rejoinder and affidavit referred to above.

Kindly await our next communication on 29th in regard to the court proceedings

The 3 Golden Principles of Accounting

Ever since I saw my friend at the Bank trying to rectify an error in initials in his fixed deposit,  my mind was unravelling  knots and contours  of an unknown future. 

Unconsciously I opened my almirah to have a re-look at all the documents and bank passbooks.
It is right time to check up whether I made all the nominations in my bank accounts, whether I made the will as formatted in the book supplied by our Vice President, and in fact whether my name has been rightly spelt in all the documents.

An error in initials may even result in wrong credit to some other account, my sixth sense warned.
Before the warning could wane, I started checking all files, right from 2001.

So many letters hand-written, half-written, torn, to be torn  pension statements 16A,  15H copies, proof of existence, and among them furious  letters to Banks questioning wrong debits of TDS etc. etc.

Too many wrong debits, in life too, I thought.  Unluckily or luckily perhaps no wrong credits ever never.

Looking at debits and credits, let me confess that my admiration for Accounting started right on the day when I was pushed to learn basics of Accountancy for compiling revenue account and balance sheet for the local institute for which I happened to be the Secretary by default for a year. Next year, to be honest, I ran away from the assignment, just to save me from the torture of debits and credits.

However, my admiration for Accounting in general and our Accounts Department, in particular, to say the least, was wholesome.

My admiration arose as  this subject of Accountancy alone introduced to me  such beautiful concepts vis a vis phrases like RECONCILE, HONOUR, ADJUST, BALANCE, PROVIDE FOR, which  later I discovered as  the grounds and pillars of better human relations leading to happiness and peace,

The 3 Golden Rules which my good friend Aartee not only taught but advised  me to keep close to my head and if possible save them closer to my heart  (way back in 1962) are possibly the only ones in the Universe which do not allow any exceptions. No ambiguity. No clarification ever sought on these rules. No need for revision or appeal to an appellate authority.

How I wished rules and laws enacted by our Parliament do not allow any scope for  exceptions ! any scope for varied interpretations  ! And Judgments  delivered that could never  be disputed or diluted !,

These 3 golden rules have such wide applications that when properly applied they lead to better human relations, justice and peace of mind, I vainly thought.

I said to myself: Let me implement all the golden rules whenever I  decide any further on that appeal.


Of the Three, the first that comes to my mind, is:

Debit the Receiver and Credit the Giver

For every credit, there is a corresponding debit.

In Share market I see, when stock comes in, money goes out.

When money comes in, stock goes out.

("Don't ask when wife comes in your life, money goes out " is another example.)

Nowadays, all of us, pensioners need all the Grace of Lord Balaji.
So, if His Grace should come in, something should go out.
Do not jump and nag  me whether that 'something" could be  donation !
Let us go step by step. We are left-brainy men. No craze for creativity.

Be sure that you and I  need Grace of Lord Venkatesa . When we all pray to Lord Sreenivasa,  He massages our hearts,possibly a message of hope is injected in our veins. . I am not talking of prasada akkara vadisal.a sweet recipe.  We feel the sweetness in our hearts . Sweating of course in purse.

I always remember my good friend who used to reply as someone curious enough asked him"Hey! how is it ! you lost  this promotion ! then he used to reply  'GOD knows. GOD IS GREAT' (that 'you" had more than a meaning.

(i  never asked him how God could know ? Those days there were no AADHAR CARDS even ! and there will names similar to him tho lose promotions also.That he never said that when he got a promotion, is besides the point. Don't quote it.)

Agreed ? Then it is high time  u come forward to pay something say x out of something say y which  you got out of His Benevolence.

 (Remember the day when everything was thrown out, this 40% alone stayed. It was just His Mercy.)

 That is the least what is asked for. You know that.
You need to give something if you want to get something.

It could be that you prayed  for 100 %, you got only 40 %. On a pradhosham day, when abishekam water is sprinkled on viewers, some get more. some get less. for some not even a drop falls on them. .But this should not make you worry and  lose heart.

Also do not leave it just like that as a hot potato.
People who sacrifice are the people who win finally also.
In any case, justice is on your side.
You are sure to get that balance 60% also.
How to get?

So apply again the 2nd Rule.

Debit what comes in. Credit what goes out.

You debit your  BLESSINGS  a/c and click the button PAY in your NEFT transaction.
You find that the money is credited to His account.

And Leave it at this

You say you know it. Then you  just pray  that the lawyers who are to argue for you should be present on that day. Pray to God that they equally  remember all the points you  painstakingly culled out and unearthed from all the judgments delivered by all High Courts throughout India.  Let them not quarrel amongst themselves. You do some special pariharam. You can think of donating a lemon size gold coin for an elderly person like me. My doors are always open . I am a 24 x 7 receiver.

Coming back to accounting, please listen.

When you put in the Great Hundi, what is due by you,
Grace comes in. Your money goes out.

What will happen ? When will happen ?
Never ask this question.
With  just hope, you will develop  the nerve to sail against swirling sea waves.

Hope for the best.  If your hope materialises, and Lord Sreenivasa @ Venkatesa @ Govindha @ Venkata ramana@'Thiruvengada mudaiyan shall certainly answer your prayers,

Let me repeat. Never ask  "When'"?

He knows when to grant .In which avatar he will be granting.

As Vamana, Narasimma, Sridhara, Parasurama, Rama, krishna.... He can come in any  form and in any name and any time. Now or in our next birth. He will certainly grant us. what is due to us.

Remember He could be NAKARA as well as SAKARA when he finally comes and delivers.

One thing I am sure is that you will indeed get much much more than what you paid.

The day will come when dharma  is finally understood  and wisdom dawns on the other side. Did not OROP come ! yes. That way  justice is hopefully delivered to us too.

Don't be surprised if your Bank Account  reveals a sudden credit entry of around 30 lakhs.( + or -  25 lakhs.)

In any case, it should be much much more than the total of debit under the column BLESSINGS  a/c




At this juncture, let me warn you that there could be another chilling thing ! Someone like Sukracharya may enter the water bottle and prevent the water from dripping.

There is also another possibility . The case may drag on and on. You may be doubtful whether in your life time, you will see the end /fruits at all.  Then what happens to your accounting?

In that case, all that you need to do is to create a provision . You do not call it Bad Blessings or Doubtful Blessings, as Lord Narayana may not be happy over it. You know when boss is not happy what happens . Let Him not  take the Narasimma avatar.

You can create a reserve by providing for such events. You see, like our colleagues who are legal men, there are equally brilliant C As amongst us. They will tell you how to create that provision without any further donation.


What shall I do if the Lord chooses not to open his eyes !! 
(This should not happen as most of pensioners' spouses are reading kanakadhara Stotram daily.)

The third Accounting Rule comes to our rescue.  Rightly , this account is called 
a nominal account

.Debit all Expenses or Loss and Credit all Income Gains or Profit
All you will have to do is:
You just pass a journal entry.

You assess the then market value of the amount shown under the debit column
Blessings a/c

Debit POORJUDGEMENT a/c
Credit BLESSINGS  a/c



All these done, I am sure your heirs will not curse you for bad accounting.

When they see your bank accounts, your check books after your possible demise, they may not shout you have mismanaged even what little you got .

You may also feel assured that this simple process is quite safe. It stands up to the 32 pairs of international standards of Accountancy.

Having said that,
Now look at the other phrases of Accountancy:
RECONCILE, ADJUST 
BALANCE.

Reconcile with what is practical and pragmatic.
(There are things which we can change. There are equally things which we cannot change. Prudence demands that we understand the difference between the two)

Adjust your way of living with the cost of living. 

Balance yourself, lest you wander out of your own zone of peace.

Am I recollecting and applying the principles  as you taught me   my friend ??? !!!

When people throng you, surround you.....


When there is a lot of praise for you, you find yourself at the Seventh Heaven of Joy.
In today's parlance, at the top of Himalayas. 

True.

But, have we ever bothered to know from where the praise comes?
Does the praise have a price ? A tag ?

Let us recall a two-line Sanskrit sloka from Subhashithani.


कार्यार्थी भजते लोकः यावत्‌ कार्यं न सिध्यति॥

उत्तीर्णे च परे पारे नौकायाः किं प्रयोजनम्॥


People praise others only to get their work done.
Or their wishes to be fulfilled. 
Otherwise, their work will not get done.


Subhashitani says in a nutshell:

As soon as you cross the river, 
what is the use of the boat ?





It happened well in 1986 or so. 

I had just returned from my tour some Andhra Division. The journey was tough but I thought that the offices I had to inspect proved tougher as they were really working well. 

(Though the goal of Audit is not fault-finding, as is said, still, when you find a couple of wrong doings that could lead to special reports, you are obliged to inform the Chief in private before you put them in writing. 

Those days when you meet the Chief, and inform your achievements (!) anything may happen. 

One. He may say.: Is it ? Let me first discuss with ZM and appraise him before you finalize it.
Second:  No...No..Never.can we allow such things...It can't happen like that. Put it immediately and bring it for my signature.
Third: You keep the report on my table. Let me think over.)

How I wished he was alone !
It was not to be.

Hardly had I entered his cabin, I found not to my surprise, my boss was talking to the second in command of our Zone. 

{Those days, we had only one ZM and one DZM. 

Only later, l.....a.....t....e...r...., when there were too many children  crying, possibly it was decided to have more than one DZM. Two decades later, if you know that I was also promoted as DZM, it dawned on me that people have by then   understood that that DZM was not such a coveted post. We had two DZMs in each floor by that time.  I consoled myself that I am another ALSO RAN CASE !!

However,  in order that officers of higher cadre should not be dispirited, they changed the name of the post. }

Oh ! Let me not go away from the story.

Coming back , did I not say that I was not surprised !
Yes. 
As both of them were very close friends. The DZM was a high voltage Chartered Accountant, perceived to be an authority in his field. 

No sooner I entered the cabin, my boss welcomed me with a warm smile, asked me to sit, and offered a cup of tea.

They continued the conversation. I listened, though at times, pretended not listening.

Seeing the big big bundles of Greetings Cards on the table, the DZM looked surprised and showed it in his face too. They were all NEW YEAR GREETINGS CARDS.

In those days you know, sending a Greeting Card was not  only customary  but mandatory too. So thought the men in the semi circle owned by marketing men. 




 People vied with one another in buying colourful cards which they thought spoke of their love and affection towards their bosses.  People wishfully thought that the the more expensive their greetings card the more secure their  place of posting. You do not also forget to add a line," how is your cute kid, Sir !"

"Why this craze? I dared one day to ask my friend.!"
"He said: This is marketing. You will have to sell yourself, before you sell your products.
True, I thought then.


"It is already 10th January. In another couple of days, Pongal Greetings will start coming. What are you doing for these New Year Greetings Cards ? Replying ?"  He aired a mischievous miniscule smile. 

"Yes. My steno could reply to only 10 to 15 per day. At this rate, it may take another week for him to complete my thanks giving letters to all."


"That's funny." The DZM said. Continued, " my steno you know is an union man. He says.: I won't type all these thanksgiving etc. I take your dictation and type only what is official. This is more personal. Anyway, let me check up with our union, before i start. ." 


"So you dropped idea of replying!?"


"Not exactly. I am sure  I would  convince him if the number was small. It exceeds 1000. "

The DZM was not exactly lamenting but it did appear to me he was surely feeling sorry for those of his fans/well wishers  who would be looking for his thanksgiving reply.

I could have kept quiet. But being what I am, I could not resist  words flow from my mouth:


"Sir ! All these Greetings and all that is not for you, Sir.! It is for your position. "


"No. You do not know their love abundant love for me. That is why they send me"  


My boss glanced at me admonishingly.
His eyes seemed to suggest: Don't tell even right things at wrong places !!

A few minutes afterwards, DZM left, and I could finish my job. I came out. 

The incident could have evaporated from my mind had I not met my boss the next year, possibly the same day, around 10th or 11th of January. 


He had already retired by that date.  As I was walking on the road leading to East Tambaram, perhaps on a sudden, he was there before me. 


The same lovable look. What a gentle face !  


"Sury ! How are you? Are you not transferred out of chennai? How are you here?"


"I am fine. Sir! I came to chennai to attend a wedding. ...." 


Even when I was continuing, he interrupted me;


"Sury ! you remember the conversation, between me and that ..............DZM last year .!!....."Pausing a few seconds, he said..."New Year Greetings."


"Yes.Sir. I do remember that incident. "


"Few days ago, he phoned up to me as usual.  He is also retired , you know."

"Yes Sir.! I know."


"He told me: he had received only three New Year Greetings this year;  and among the three, he laughs one is mine.! " 


"What if ?"


"The point is he still remembers what you said to him last year: Actually I forgot about it"


"He adds that the other two are from apprentices who have joined his firm. you know after retirement he has joined a big firm of Auditors "


"I know "


We then talked another few minutes and left. 


As I reached home, I was still reflecting on how birds from distant lands fly thousands of miles  en masse to watery lakes.

All in search of water.
To quench their thirst.! Of course !







Would the birds come at all if there was no water ?

Just as watery lakes are swarmed by thirsty birds, so are surrounded men by needy and expectant people. The moment their desires, expectations  evaporate  they fly away. 


This is not to decry the visitors. More to say that their visit is justified.
But the moment their expectation evaporates, dries,   your home is forlorn.



I was reminded of a beautiful subhashitani sloka.


काकः कृष्णः पिकः कृष्णः को भेदः पिककाकयोः ।
वसन्तसमये प्राप्ते काकः काकः पिकः पिकः ॥


The crow is black. The nightingale is also black. Who can tell the difference between them both? But when it is spring time, it becomes very clear that a crow is a crow and the nightingale is a nightingale.


Most times, you know the truth. But you are forbidden to say.
Why?
There could be many reasons.
One could be THE PREVAILING SITUATION.

Whatever you say may not reach the head of a deaf person.

Much ahead of Bhishma and Drona, much much more than Bhishma and Drona,
Vidhura knew .
But rarely he talked .
He knew that talking right at wrong places
would never fetch the desired results.

The true great gentlemen is someone who does not discuss master and servant, what is right and what is wrong, beauty and talent. 

He does not spend his whole time discussing.

 As for this monk, if someone comes, whether monastic or layperson, he is able to see through to that person's sources and recognize that the sounds, expressions, writings that he uses are illusory dreams.

There is a Chinese proverb that says, "If you win, you are......

"Tukrangarane " just means the rules of grammar literally.

When you and I go into what is said:

All through our lives, we have been talking, discussing, having discourses . In short, unwanted discussions which led us nowhere.

We have forgotten to think of Govindha.  So worship Govindha.

(Do not lose time in other pursuits.) Oh ! foolish mind !!

When the final moment comes, nothing of what you have been discussing, comes to your rescue.

Think of Him.

Last Tuesday, I met a friend of mine for more than five decades.
He was standing with the help of a four-legged stick in a  queue,
Before a Counter in a Public Sector Bank. There were four people before him.

Why ? This old octogenarian should be here in pain and distress?
What does he want?
I approached him and said:
Hello ! Why? Why are you standing here?
What do you want?"  

"Nothing big sury."

"then?"

"you know, I received some 40 thousand as arrears . That 40 per cent u know!"

"yes.I know"

"I put this in FD for 5 years. Then only u get 7.85 per cent. With senior citizen advantage, I get another .25 percent more here. I checked the receipt only when I was back home. 
My initials was put as P instead of R.
I phoned up to the Bank and they said 'you bring the receipt"
Yesterday, when I was here, they took my application, and said, you have written 
only as P . The FD is prepared only according to that.
you know. Because my fingers are not steady, I have written only R but, true it looks like P."

" What did you do ?"

"They wanted me to correct the application. When I did it, erroneously I cut that letter itself. 
So they wanted to  write again.
So I took another application form, went home, got it filled up by my son, and came back today."

"in this hot Sun ? you came all the way walking?"

"What can I do ? I was waiting for 18 years to get that 40 per cent. I am made to wait for another 2 days . That does not matter much."

40 k is not a small amount. interest is around roughly 3200 per annum. Roughly 267 p.m. roughly Rs.8 per day. 


I do not grudge. Never.  Even small amounts help. There is nothing which equals hard cash in old age.

What do we do here ?



It all started as a routine meeting of all faculty. The second fortnight of March it was.

Yes. You guessed it right. Whenever we had no other work, 
we were called to attention. 

we meet and discuss.

On that day as we , i mean, all faculty, met at the spacious hall of our Principal ,  the meeting wore an air of expectation.

Yes. A dignitary from CO was visiting our centre to interact with all faculty.  The boss said he expected the dignitary to have a didactic  discussion with every faculty too.

Why should it be like that ? asked an ever inquisitive friend..
"I wish you better put this the question straight to him." said our boss.

The meeting was to take place at 2.30 p.m.  It is was already 3.00 p.m. but yet the visiting dignitary was not in sight.  Nor was there was any message from him.

A couple of our friends (faculty) appeared tense.  To them this meeting appeared to be more than a routine. They were, as we knew, in the reckoning for promotion to a higher cadre.  A third one was also similarly placed but never revealed so much interest in the matter of promotions. To him life at the centre was a comfort zone and possibly he was enjoying it.  A promotion may entail in a shift which disturbance he could hardly afford to face at this age.

In any case, everyone knew that basis of promotion to a higher cadre at least DMs and above were based mostly on perceptions rather than the usually talked about CRs.

I knew the dignitary even before. He was a highly placed marketing man during his tenure here at chennai.

Much as I would convince my colleagues to treat this meet as another one, the tense face my colleagues sported could hardly be camouflaged.

At last the dignitary came, and the meeting started.

With a brief self introduction  by each faculty (was it seven or eight ?) being over, the dignitary started addressing us.

A few minutes passed.  A few faculty listened with rapt attention, with their eyes half closed. Dreaming or dozing I did not verify.  A couple of others possibly thought that he was not telling anything which we were not ourselves conveying in our class rooms. 

Then suddenly there was a pause.

His  silence made us wake up.  In measured tone 
he aired a question.

 "how do faculty  feel being in a training environment, after having been in the marketing area ? "

In 80s and 90s, officers from the side of sales were prone to feel embarrassed on a posting to Training Centres. Is that feeling of being ambushed still lurks nowadays   among sales-side officers ? I do not know.  For them  a posting as a faculty in the Training Centres was perceived as a punishment !! 

I do remember during the days of my induction training , a co-participant at MDC, who had served as  Senior DM in charge of some Division in Gujarat, could not swallow the posting which he said shocked him especially after a brilliant performance. I remember he even  dared to air his protest at the inaugural day in front of MD.

Back to the story.

Responses to the query were on expected lines.   

"Quarantine leave" one said. 

Another said that he enjoyed as he could relate himself with sales force from a different linguistic area.  He learnt to enjoy chakka pradhaman, and learnt Malayalam. Said, " It would help me if I were to get posted  as SDM at Trivandrum, you know. "

A third one philosophically suggested that "ups and downs always happens in life - you know".

The dignitary turned his eye on faculty who belonged to other shades,their  backgrounds assorted . Fellows of Insurance Studies, a half (not half-baked) Actuary, a CA, a legal man , and a couple who rose from ranks. not DROs.

"What do we do here ?"  He put it straight.

There was a dry laughter amidst all.

Several replies must have come to their minds they carefully chose not to convert as words such as:

"chatting", "lecturing" "group dining"  "shepherding trainees"

One faculty came forward to define his role. Possibly remembered the sentence he read at MDC. 

 "The trainer's job at the Training Centre is to enhance and elevate the levels of skill and knowledge,  shape , mould and motivate the trainee officers to develop the right type of attitude based on their own aptitude. In short, it is to inform , perform and reform."

" He is in full form."A neighbour of mine hissed in my ears: 

"you are too technical. Make it straight. More simple ?" the dignitary suggested. 

"Sir ! We impart training on rules and regulations, in fact we explain the basis of several CO circulars . You know - 'to read and understand these manuals our executives  do not have enough time in their working environment.'  So we teach. "

"You are beating about the bush. " laughed the dignitary. 


Putting Emphasis on the word, 'teach' 
he asked: 

"Do we really teach here ?" 

So teasing , short of annoying, was his question, that faculty possibly had no answer.

A friend of mine about to retire hissed:  "We preach also."

He turned at me.

I said : " I learn "

"what ? you mean  the ALITER CONCEPT  ! "

After a pause, I replied, "Yes Sir. I learn here to unlearn."

Another "What " from the CO man.




"In fact, I see this as an opportunity to unlearn everything I have learnt in the last thirty three years or so. When I interact with men and women who assemble here, I feel I have more things to learn from them than I have to give them."

My colleagues looked at me. Our own boss appeared visibly perplexed. He was possibly wondering whether  any chance of being promoted at all in the rest of my career,I had already lost.   In any case,little it mattered to him as  he always knew me as one incorrigible.

"So you say you have begun shaping yourself !" 

"In a way. yes. the period one spends here should enable one to develop a vision not only for oneself but for the organisation too.  "

"Will u develop that idea ?"

"The trainees who come here do exhibit a lot of ideas creative. By interacting and working with them, though for a limited period, it is possible to distance ourselves from our past ways of doing  jobs and find new routes for higher performances."

"You say then you are not teaching here."

"Possibly yes,if you assign a conventional meaning with the word. In fact,   I relate with those who come, pose before them a few situations and just observe. Our job, as i feel, is to create an environment where they could visualise and  set new goals for themselves  in the organisation."

" you feel it is worth ! you feel it is necessary?"

 Sir ! I have always a conviction, that if men are enabled to design their jobs, they exert and excel. Their contribution to  the organisation also reaches higher levels.  "

"Where are you then......? "

"you may call us a catalyst in the  process . And in the process,  I see I also grow.  I believe when I go from here, I shall be a transformed person."

The CO dignitary looked at my boss. Said, "it depends ."

"Why not we have a tea-break ! " he suggested.

The snacks had come by that time. Biscuits, fried  cashew nuts,, somosa and tea.





What ! Is there an alarm bell ringing?

 I wake up.

Getting composed.

At this old age, i am already 74 +, events of past do come as dreams

But how come !  All the faces of my close dear friends and equally their voices !!
